Terms and Conditions

Effective Date: May 30, 2026


Welcome to South Cove Experiences ("Company", "we", "our", or "us"). By accessing our website, booking a tour, purchasing a service, or participating in any experience offered by South Cove Experiences, you agree to be bound by these Terms and Conditions.


If you do not agree to these Terms, please do not use our website or services.


1. About Our Services

South Cove Experiences provides guided tours, transportation arrangements, customized itineraries, educational experiences, and related tourism services on and around Big Tancook Island, Nova Scotia.


All tours, experiences, schedules, and offerings are subject to availability and may be modified or cancelled at our discretion due to weather, safety concerns, transportation disruptions, operational requirements, or other circumstances beyond our control.


2. Bookings and Payments

All bookings must be made through our website's approved booking platform, email, or other authorized booking channels.


Payment will be required in full at the time of booking unless otherwise agreed in writing.


Prices are listed in Canadian Dollars (CAD) and are subject to applicable taxes.


A booking is not confirmed until payment has been received and a confirmation has been issued.


3. Cancellations by Guests

Unless otherwise stated for a specific tour or event:


  • Cancellations made more than 14 days before the scheduled experience are eligible for a full refund.
  • Cancellations made between 7 and 14 days before the scheduled experience are eligible for a 50% refund.
  • Cancellations made less than 7 days before the scheduled experience are non-refundable.
  • No-shows are non-refundable.


We reserve the right to make exceptions in cases of emergency at our sole discretion.


4. Cancellations by South Cove Experiences

We may cancel, postpone, modify, or reschedule any experience due to:


  • Severe weather conditions;
  • Ferry disruptions or transportation interruptions;
  • Safety concerns;
  • Insufficient participant numbers;
  • Guide illness or emergency;
  • Circumstances beyond our reasonable control.


If we cancel an experience, guests may choose either:


  • A full refund; or
  • Rescheduling to another available date.


Our liability is limited to the amount paid directly to us for the affected booking.


5. Transportation and Ferry Services

Experiences require travel to or from Big Tancook Island using ferry transportation services operated by the Nova Scotia Department of Transportation & Infrastructure Renewal.


We are not responsible for:


  • Ferry delays;
  • Ferry cancellations;
  • Transportation interruptions;
  • Government transportation decisions;
  • Weather-related travel disruptions.


Guests are responsible for verifying transportation schedules and arriving with sufficient time for travel.


6. Participant Responsibilities

Participants agree to:


  • Follow all safety instructions provided by guides;
  • Respect private property, community members, wildlife, and the environment;
  • Wear suitable clothing and footwear;
  • Disclose any relevant medical conditions or mobility limitations before participation;
  • Refrain from behaviour that may endanger themselves or others.


We reserve the right to refuse service to any participant whose behaviour is unsafe, disruptive, abusive, intoxicated, or otherwise inappropriate. No refund will be provided in such cases.


7. Health and Fitness Requirements

Some experiences  involve walking, uneven terrain, cycling, vehicle travel, exposure to weather conditions, or other physical activities.


Participants are responsible for determining whether they are physically capable of participating.


If you have medical concerns, mobility limitations, allergies, or other health considerations, please contact us before booking.


8. Assumption of Risk

By participating in any tour or experience, you acknowledge that outdoor tourism activities involve inherent risks, including but not limited to:


  • Slips, trips, and falls;
  • Uneven terrain;
  • Exposure to weather conditions;
  • Wildlife encounters;
  • Transportation-related incidents;
  • Personal injury or property damage.


Participation is voluntary and at your own risk.


9. Limitation of Liability

To the fullest extent permitted by law, South Cove Experiences, its owners, employees, contractors, agents, and partners shall not be liable for:


  • Indirect, incidental, consequential, or special damages;
  • Loss of income, enjoyment, or opportunity;
  • Personal injury, illness, or property damage arising from participation in our services, except where caused by gross negligence or intentional misconduct.


Our total liability shall not exceed the amount paid by the guest for the applicable booking.


10. Release and Indemnification

Participants agree to indemnify and hold harmless South Cove Experiences and its representatives from any claims, damages, losses, costs, or expenses arising from:


  • Breach of these Terms;
  • Participant negligence;
  • Participant misconduct;
  • Violation of applicable laws.

11. Photography and Media

During tours and experiences, photographs, videos, and recordings may be taken.

Unless you notify us in writing before the experience begins, you grant South Cove Experiences permission to use photographs or recordings containing your image for promotional, marketing, website, social media, and advertising purposes without compensation.


12. Intellectual Property

All content on this website, including text, images, graphics, logos, videos, branding, and design elements, is owned by or licensed to South Cove Experiences and is protected by applicable intellectual property laws.


No content may be copied, reproduced, distributed, or used without our prior written consent.


13. Website Use

You agree not to:


  • Use the website unlawfully;
  • Attempt to interfere with website security;
  • Upload malicious software;
  • Access restricted systems without authorization;
  • Use website content for commercial purposes without permission.


We reserve the right to suspend access to users who violate these Terms.


14. Privacy

Personal information collected through our website or booking process is handled in accordance with our Privacy Policy.


By using our website and services, you consent to the collection and use of information as described in that policy.


15. Third-Party Services

Our website may contain links to third-party websites, booking systems, payment processors, transportation providers, or tourism partners.


We are not responsible for the content, availability, policies, or practices of any third-party service.


16. Force Majeure

We shall not be liable for delays, cancellations, or failures caused by events beyond our reasonable control, including:


  • Weather events;
  • Natural disasters;
  • Government actions;
  • Public health emergencies;
  • Labour disputes;
  • Transportation interruptions;
  • Utility outages.


17. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Province of Nova Scotia and the laws of Canada applicable therein.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Nova Scotia.


18. Changes to These Terms

We may update these Terms and Conditions at any time without prior notice.

The most current version will always be posted on our website and will take effect upon publication.

Refund & Cancellation policy

REQUEST FOR REFUND


You may be eligible for a full or partial refund based on:


  • The reason for your cancellation
  • The date your cancellation is received
  • The up-front cost South Cove Experiences has assumed for your tour


Refund requests must be made by email to katherine@southcoveexperiences.ca. 


CANCELLATIONS


  • A full refund will be issued for cancellations made within 48 hours of booking
  • A partial refund of 50% will be issued for cancellations made at least 14 days in advance.
  • No refund will be issued for cancellations made less than 14 days in advance. 


The only exceptions to this policy are in instances of ferry cancellation or force majeure:


Force Majeure includes impersonal events such as war, civil insurrection, strikes, volcanoes, extreme weather, earthquake or natural disaster that makes it dangerous or impossible to safely undertake the tour. The determination of what constitutes 'Force Majeure' is at the discretion of South Cove Experiences. However, a travel warning issued by the Canadian Government or US Department of State AFTER you book your tour invokes 'force majeure', you are covered under this 'Force Majeure' provision.
